| 摘 要： | 本文从事物发展逻辑次序的角度揭示了中国法治建设的逻辑起点 ,澄清了中国法治建设的起点问题 ,纠正了中国法治建设研究中“言必谈西方”的局面。从历史的角度看 ,中国今天进行法治建设的历史起点是原始法治 ,而现实起点基于这样几个方面 ,即中国社会主义市场经济、中国共产党的领导、中国农村与城市所构成的二元结构及汹涌而来的全球化浪潮

| Abstract: | This essay unveils the logical of starting point of legal system in China on the perspective of logical order.By this essay, the author wants to clarify the starting point of Chinese legal system,as well as the situation that western legal schools dominated Chinese legal fields.Historically speaking,the ongoing legal system has inherited from aboriginal legal system in China.On the other hand,the starting point of current legal system in China is based on the following aspects:the socialist market economy,the leadership of Chinese Communist Party,the binary social structure based on the city and village and the sweeping globalization drive. |
