检察机关量刑监督制度刍议

检察机关是国家的法律监督机关,履行刑事审判中的量刑监督职责是检察机关行使法律监督权的重要内容。然而,司法实践中的检察量刑监督制度受到了来自我国现行立法、检察机关自身以及司法审判机关等各方面因素的影响,严重削弱了量刑监督的法律效果。故检察机关有必要对现有的量刑监督制度予以改革并完善,以实现量刑公正的终极目的。

Perfection of the Sentencing Supervision System from the Perspective of Prosecution

The People’s Procuratorate of China is the legal supervision organ provided by the Constitution, and the implementation of sentencing supervision in the criminal justice is the important content of its work. However, in judicial practice the prosecution sentencing supervising system is influenced from current legislation, the People’s Procuratorate, People’ Court and other factors, which have seriously weakened the legal effect of sentencing supervision. Therefore, it is necessary for the People’s Procuratorate to reform and improve the existing supervising system in order to achieve the ultimate purpose of sentencing fairness.
