| 摘 要： | 河南民间文化遗产蕴藏量极为丰富,但随着社会现代化进程和农村城市化步伐的加快,这些遗产面临着前所未有的冲击,许多文化遗产都不同程度存在失传和消失的危险。河南省民间文化遗产抢救工程启动以来,在保护与开发中,也存在与现代知识产权制度难以完全直接吻合、缺乏权利与利益分配保障机制等问题,如何恰当运用知识产权法律制度是值得研究的。

| Abstract: | There are a lot of folk cultural inheritance in Henan province but these treasure meet unprecedented impact today.They are disappearing with the development of modernizing country.Salvage project on folk cultural inheritance has being in a difficult position because of the contradiction with modern system of intellectual property rights.So it is necessary to research how to resolve these problems. |
