简论公序良俗

公序良俗的本质是伦理化规则的延伸 ,它是民法的一大基本原则。但由于各种原因 ,公序良俗一直未能在我国民法中获得应有的理解和承认 ,制约了我国民法的发展。充分认识公序良俗的本质、法律功能及它在民法中的确立问题 ,有利于民法原则的体系性整合 ,有利于民法适应的地方化 ,有利于民法与国际私法统一 ,有利于社会资本的培养和市场经济的发展

Concise comment on "Public order and good morals"

Public order and good morals is one basic principle of the civil law,and it has the most important effect on the explanation,application and development of the civil law.For some reasons,the principle of public order and good morals has never got the understond and acknowledged in the civil law of the public,and the development of the latter is accordingly limited.Today,while the civil Code is under constructing,it is necessary to review the principle carefully,establush and develop it in the light of reason.This paper has three parts,discussing separately the essence,the juristic function of the principle,and its acceptability in our Civil Law.The purpose of the paper is to arouse the understanding and re-understanding of the society to the principle,and to advance the development of the principle,even the civil law in the real process of "rule of law"on the basis.
