| 摘 要： | 随着中国经济的发展和对外开放,具有扎实的民商法专业理论知识的复合型法律人才在法律人才中的需求比例将越来越大。然而,从目前商法教育来看,尚局限于"以法论法"的注释法学教学模式,对于交叉学科综合研究重视不够,学生的综合能力差,存在"高分低能"现象,法学专业复合型人才的供给短缺问题日益严峻。这和市场经济生活方式不相契合,和中国的市场法治实践也存在着严重的脱节。在商法教学中引入经济分析方法对改变商法教育的现状具有必要性和可行性,对于培养复合型法律人才将大有裨益。

| Abstract: | With the development of economy and open policy,there is greater and greater need for versatile talents equipped with theory of civil and commercial law,however,the present commercial law education in China is still limited in the teaching method of interpretation and short of a synthetically study on crossing courses.It is necessary and feasible to apply the method of economic analysis to commercial law teaching and will be of great benefit to cultivate versatile talents of legal education. |
