| 摘 要： | 刑事诉讼目的是刑事诉讼法学研究的基本理论问题，迄今为止，以惩罚犯罪和保障人权相统一的刑事诉讼目的论、正当程序和保障人权统一的目的论、发现真实与保障人权的目的论、实施刑事实体法的目的论以及纠纷解决的目的论都存在理论上的缺陷。刑事诉讼目的应当是以观念形态表达出来的国家和参与诉讼的当事人对于刑事诉讼结果的正当期望，是在正当法律程序保障下，发现事实真相，实施刑事实体法，解决刑事纠纷，实现实体公正。

| Abstract: | The purpose of criminal proceedings is a basic theoretical issue. So far there has been inconsistency between the punishment of criminals and the safeguarding of human rights as well as in other related aspects such as the relationship between proper procedures and the security of human rights. It is thus important to find new expression for the purpose of criminal proceedings. |
