农村集体土地所有权主体问题探讨

农村土地集体所有制是计划经济时代的产物,也是我国半个世纪以来城乡社会经济二元化体制的制度基础。正确认识和明确农村集体土地所有权主体应当从其法律渊源入手。农民集体应当是农村集体土地所有权的常态主体,村民小组范围内的农民集体和乡镇范围内农民集体不是我国农村集体土地所有权的常态主体,而仅为特例。由于农民集体是由人数众多的农民个人组成,其所有权常常需要一个机构或组织代理行使。应当建立类似股东大会的机构,设立农民集体大会作为所有权主体,而由农民集体大会在选举一个较为固定的组织,作为农民集体的代表行使所有权有关的事务。
