媒体监督、司法活动与价值平衡

媒体监督一方面使得司法活动更加透明公正;另一方面,影响司法独立,公民的部分权利受到侵犯。媒体监督与司法活动之间会发生冲突,其原因在于:法律事实有别于新闻事实;司法独立排斥媒体监督;媒体报道的及时性与司法活动的程序性相矛盾;媒体的感性与司法的理性存在对立。媒体机构与司法机关之间实现良性互动,应通过法治途径,扩大司法信息公开的范围,提高媒体和司法的自律。

Media Supervision,Judicial Activity and Value Balance

On the one hand, media supervision makes judicial activities more transparent and fair; on the other hand, media supervision interferes with judicial independence, the citizens＇ parts of rights has been violated. Because legal facts are different from news facts, judicial independence excludes media supervision, media reports＇ timeliness and procedural activities of judicial are contradictory, and the media＇s sensibility is opposite to justice＇s rationality, the media supervision is often conflict with impartial justice. In order to achieve positive interaction between the media and judicial authorities, we should take legal methods, expand the openness scope of judicial information, then improve the media＇s and the judicial authorities＇ self-discipline.
