| 摘 要： | 新民主主义革命根据地的民事诉讼制度 ,从大革命时期的调解机制起 ,至解放区的各种政策、法律、规章的不断建设 ,从中可以看出 ,置身于当时特定历史语境所发展起来的制度和方法是成功的 ,且未必不可以看作是一种“理性”制度 ,或称其为“法律的‘治理化’传统”。当我们步入 2 1世纪 ,着力于市场经济体制下“依法治国”建设的时候 ,对前人走过的历程予以回顾与总结是十分必要和有益的
