| 摘 要： | CISG是合同的国际统一法,也需要在缔约各国统一适用。本文盘点和归纳迄今为止德国法院运用和解释CISG第39条第1款的司法实践,在此基础上提出德国的司法实践对CISG的统一适用和《中华人民共和国合同法》第157条和第158条所带来的启示。

| Abstract: | United Nations Convention on Contracts for International Sale of Goods is an international uniform law of contracts and need to apply uniformly to all contracting states.This essay reviews and concludes the judicial practices in which the German courts has cited and interpreted Article 39 Paragraph1 of the CISG up to now,and on this basis puts forward some revelations to the uniform application of CISG and Article 157 and 158 of Chinese Contract Law. |
