清末民初奉天省的司法变革

以区域研究的方法,考察奉天省自清末新政开始到张作霖统治结束为止这一时期司法体制所经历的变革。奉天省在民国初期政局动荡的大环境下新式法院却以较快的速度增长,在数量上领先于全国其他省份。同时在民国初年法院改组时确立的担任司法官所需要的学历要求,在实践中得到了较为严格的执行。最后从地方政权建设和收回治外法权运动这两个因素入手,分析这一现象产生的原因。

On the Judicial Reform of Fengtian Province at the Turn of Qing Dynasty and the Republic of China

By applying the regional study method,in this paper the author investigates the transformation of the judicial system in Fengtian Province commencing in the late Qing New Policy reform period and the end of Zhang Zuolin's governance.The author points out that the effort to create a modern judicial system was an essential aspect in this period,even though by and large,the political environment was dominated by war and instability.Meanwhile,from the perspective of professional training,this period underwent a process of professionalization of judicial officials.Such a phenomenon can be explained in two ways: Under Zhang Zuolin and Wang Yongjiang's governance,Fengtian Province enjoyed a stable political situation and a strong and prosperous economy;Chinese elites endeavored to abolish consular jurisdiction.
