| 摘 要： | 首先对商业贿赂的概念和构成要件进行剖析,在此基础之上对查处商业贿赂案件所遇到的诸多困难作简要阐述,并对照《联合国反腐败公约》审视我国商业贿赂刑事立法之不足。指出对这些困难的审视及刑事立法的反思与借鉴无疑是我国商业贿赂立法完善的前提性条件之一,并期这样的努力对正在开展的治理商业贿赂专项工作有所裨益。

| Abstract: | The paper gives out the definition of business bribery and its components.Then it presents the nasty problems in checking it.It also goes into the weak points in Chinese legislation in light of the UN Anti-Corruption Convention.It upholds that a survey of the difficulties,a reflection of the problems in legislation,and an introduction from overseas are the premise for a good law against commercial bribery in China.Such efforts will turn out beneficial to the anti-bribery drive in our country. |
