我国国际河流法律研究中的几个问题

我国缺乏系统的国际河流法律理论研究,现有的研究成果在价值取向、法律理念、以及借鉴其他地区经验等方面出现了一些偏差。国际河流法就是国际间关于国际河流利用与保护的具有法律约束力的原则、规则和制度的总和,主要表现为国家间的各种河流协议。我国应该积极与周边各国协商缔结各式各样、针对不同需要、解决不同问题的条约,并可考虑牵头缔结泛东亚区域国际河流公约,补充和完善国际河流法。

Issues on Legal Studies of International Rivers in China

Lacking the fundamental legal theory on international rivers,the existing researches have several deviations such as value orientation,legal idea,and experience learning from other regions.The Law of International Rivers(LIR) concerns all the principles,rules or system relating to utilization and protection of international rivers.There are various rivers agreements between countries are its manifestations.China should actively enter into consultations with the neighbor countries to sign various treaties to meet different needs and solve different problems,and may consider a Pan-East Asian international river convention in order to improve The Law of International Rivers.
