环境公益诉讼“公益”之探讨

目前关于环境公益诉讼问题的讨论大多集中在国外环境公益诉讼状况、在借鉴的基础上如何构建我国的环境公益诉讼以及环境公益诉讼的特点是什么等问题上。相较之下,对环境公益诉讼中的"公益"如何定位以及"公益"的表现何在,学界却关注不够。而这两个问题应该是建构公益诉讼制度中最基本,也是最重要的问题。因此,从公益的性质入手,在将国家利益、社会利益和带有不特定多数人利益的社区利益归为公共利益的基础上,分析环境公益诉讼中"公益"的内涵,可得出利益的性质与诉讼目的共同决定了某一环境诉讼是否属于环境公益诉讼的结论。
