论专利权保护与平行进口问题

平行进口是近年来知识产权保护中的一大热点问题。对于“权利穷竭”理论与“地域性”理论的研究取向,成为可否适用平行进口的关键之所在。由于世贸组织的《与贸易有关知识产权协议》没有提出明确和统一的原则,因此各国根据本国国情及利益趋向而采取不同立场。中国就平行进口问题依照TRIPS和专门的知识产权条约的相关规定,形成了自我发展的立场。我们从国际货物贸易中的专利平行进口问题的含义,重点以“权利穷竭”原则与“地域性”原则两种理论依据有关专利平行进口内容进行分析。认为我国专列汉以进口权来禁止平行进口比支持平行进口更充分。

Reach of laws problem about the protection of right of patent and parallel import

Parallel import is a hot issue in protection of intellectual property recently.Then the direction of research on the theory of " The Exhaustion of Rights" and " The Regional Differences" will decide whether a case can be applied to the restrictions of parallel import.Because the WTO and the agreement on intellectual property about trade don't provide clear and unified instructions,different countries take different views and actions on parallel import according to their national conditions and their interests.China has developed its own standpoint on it according to the TRIPS and the corresponding restrictions in the treaty of intellectual property.This essay will expound in theory about parallel import.And the emphasis will be put on the analysis of the theoretical exploration about the principles of " The Exhaustion of Rights" and " The Regional Differences".In this essay its own judgment will be made on the tendency of law-making of parallel import intellectual property.
