| 摘 要： | 依据犯罪构成理论对我国刑法关于重大环境污染事故罪的规定做了一些分析,明确了重大环境污染事故罪的犯罪客体、客观方面、犯罪主体以及主观方面的特征;在此基础上对重大环境污染事故罪的有关问题做了进一步的探讨,指出了其立法的不足之处;最后就重大环境污染事故罪的立法完善提出了一些建议。

| Abstract: | This paper starts with an analysis of regulations to the crime of heavily-polluting environment accident on the basis of the theory about crime commitment, and then clarifies the features of both the objective and subjective sides of such a crime.Based on the analysis, this paper has a further discussion on the relevant problems and meanwhile presents some points against the deficiency of the legislature. Finally it put forward some suggestions for the completion of the law-making. |
