| 摘 要： | 根据国际法上领土取得方式之一———先占原则,通过事实的考证及法学理论的探讨,分析了中国对该海域拥有主权的法理依据,提出了南沙群岛在中国发现以前是无主地,它是由中国人民最早发现、最早利用、最早归入中国版图和行使管辖的,中国对其享有先占权。从而说明南沙海域历来属于中国,领土主权不容置疑。

| Abstract: | The paper based on one of the ways of territory obtaintion in international lawpre-empt principle,using theory relating to practice method,discusses the jurisprudence foundation that our country has the sovereignty to the sea area,in order to safeguard our country dominion.Nansha sea area has belonged to China from time immemorial.The territory sovereignty is unquestionable. |
