| 摘 要： | 现代刑事诉讼法律制度有着坚实的文化根基，即人权理念是现代刑事诉讼生态的价值基础，民主宪政是现代刑事诉讼生态的政治基础，市民社会是现代刑事诉讼生态的社会基础，契约精神是现代刑事诉讼生态的思想基础。中国刑事诉讼现代化在不断推进制度改革的同时，应当不断夯实其文化根基。

| Abstract: | The system of modern criminal procedure is based on a sound cultural foundation,with the principle of human rights serving as its value basis,a democratic constitutionalism as its political basis,a citizen society as its social basis,and the contractual spirit as its ideological basis.At the same time,as the modernization of Chinese criminal procedure enhances the institutional reform,it is imperative to stablize its cultural foundation. |
