一般行政程序及其司法审查

学界对行政程序的关注与研究局限于“法定行政程序”,一般行政程序也具有行政程序的价值,大量的游离于法规范以外的一般行政程序正沦为恣意行政的借口,侵害着相对人的合法权益,毁损着诚信政府的形象,一般行政程序也应纳入司法审查的范围,司法审查的着眼点在于程序合理正当。一般行政程序违背了程序合理正当的,也应视作严重违法,是无效的行政行为,法院应作出撤销判决。

General Administrative Procedure and Judicial Investigation

The paper holds that general administrative procedure should be put into the scope of judicial investigation,the key point of judicial investigation should be rational with the procedure.A general admi8nistrative procedure when it goes against rational procedure should be regarded as seriously breaking the law and become invalid action,and be withdrawn by the court.
