量刑程序改革之思考

量刑程序对于保障量刑公正、实现司法正义具有重要意义。目前我国混合式的量刑程序存在许多不足,必须进行改革。同时,司法机关的改革试点、学界的学术研究、国外成功经验等也为其改革提供了条件。但改革要从本国实际出发,既要注意合理借鉴国外成功经验,又要注意结合本国实际情况,建构独具特色与符合国情的量刑程序。
