| 摘 要： | 商标的反向假冒应涵盖隐性反向假冒行为。商标的反向假冒是侵犯商标专用权的行为,在我国现行法律体系和框架内,应由《商标法》和《反不正当竞争法》共同规制。为适应加入WTO和社会发展需要,对情节严重的商标反向假冒行为应予以犯罪化。在设立反向假冒商标罪之前,可通过司法解释对现行《刑法》第213条进行扩充解释,将商标反向假冒行为纳入刑法规制。
