| 摘 要： | 刑法学派乃是各种刑法理论的派别,产生于刑法理论的发展过程之中.刑事法治建设的一个必要前提是刑法学界有不同观点的学术争鸣,允许存在不同的学派.反观中国,虽然刑法学界因研究领域划分或以所用研究方法分歧等原因而形成的学术争鸣一直没有停止过,但离真正意义上的刑法学派的创立尚有较大距离.仍需加强的是,学者们须增强学派意识,促成"百家竞起,异说纷争"的学术研究局面,力创刑法学派,以推动刑法学研究走向世界、走向本真.
