| 摘 要： | 案件事实作为一个概念无论是在学界还是司法实践界都如同"事实"这个概念同样被混乱地使用着。不同语境下"事实"被赋予了不同的内涵。同时对于案件事实的性质究竟是主观性还是客观性人们也存在较大争议。但是从本质上讲,案件事实是以案件的客观事实为指向的主观判断的结论。

| Abstract: | As one notion,case fact is always misused not only in the study field but also in the administration of justice practice.The fact is given different meanings according to different contexts.At the same time,there is much dispute on the nature of case fact-is it objective or subjective? But in essence,case fact is a subjective definition depending on the objective fact of the case. |
