| 摘 要： | 对虚假清洁提单进行了概述,并从一般保函的效力出发,讨论了虚假清洁提单项下保函的效力,在此基础上对我国《海商法》关于虚假清洁提单项下保函的效力认定进行了阐述,认为虚假清洁提单项下保函的积极作用大于消极作用,且有必要确立其效力的判断标准。

| Abstract: | An overview of false clean bill of lading is conducted,and the effectiveness of the LG under it is discussed by comparing with the general letter of guarantee.By interpreting the identification of LG effectiveness under the false clean B/L according to the Maritime Law,it is proposed that the positive effect exceeds the negative effect as to the LG under a false clean B/L,so it is necessary to establish the criteria for judging its effectiveness. |
