| 摘 要： | 法律与道德的关系是一个古老的法哲学问题,该问题的讨论主要发生在西方的法哲学领域。自然法学派和分析实证法学派对此问题持有相反观点,讨论最激烈的要数哈特与富勒之论战。通过解读他们的观点,深刻剖析了其对我国法治建设的现实意义,以促进我国法治建设的进程。

| Abstract: | The relationship between law and morality is an old topic in the western philosophy of right,upon which Natural Law and Positive Jurisprudence hold contradictive opinions.And the debate between H.L.A.Hart and Lon L.Fuller is the most famous and the hottest.It is expected to figure out the realistic significance to our legal construction and promote our legislation process through analyzing their perspectives. |
