| 摘 要： | 国家成为国际犯罪主体的可能性与必要性基本得到了大多数学者的认同,但就国家是否能承担其所为的国际犯罪的刑事责任以及如何承担刑事责任的问题在学界颇有争议。试从分析各学者关于国家能否承担国际刑事责任的观点入手,并就如何实现国家刑事责任的方式作一探讨。
