| 摘 要： | 在德国民法中,同时存在一对容易引起混淆的概念,即"法律交易"和"法律行为".法律交易与法律行为的不同之处在于,法律交易必然包含意思表示要件,一般包含形式要件.除此之外,其构成要件还可能蕴含原因或约因.所以从法律交易入手来对比研究原因与约因,并从原因与约因来推导法律交易的性质,应该是一个可行的方法和可能的进路.

| Abstract: | There is a pair of concepts,legal transaction and legal action,caused confusion easily,in Civil Law of German.Legal transaction differs from legal action in many ways,legal transaction includes the condition of declaration of will and dorm condition mostly.Besides,it maybe include condition of consideration or cause.Then there ought to be a viable method and way,researching consideration and cause contrastingly in aspect of Legal transaction and deducing character of legal transaction from consideration and cause. |
