Legislation of Rcal-Estate Management: Reflection on Some Questions

Introduced in this paper is the author's view on some t opics of genera l interest in the issue of real-estate management legislation:a) principles of r eal-estate management legislation.Legislation at the state (central) level or at decentralized locality level should follow this criterion --to legislate on a n orderly and step-by-step basis;b) the legal status of the Board of Estate-Owne rs.The author argues that,as an autonomous organization representing the estate- owners of the residential guarter,the Board is the subject for civil liability o f limited ability; 3)legal liability of estate management companies.The legisla tion for these companies' liability is applicable to the principle of liability on the faulty part.In special circumstances,the legislation can be applicable to strict liability. The owners' conference,or the contracts agreed upon by both t he Board and the Company are the basis on which liability shall be recognized.
