| 摘 要： | 毛泽东在中国革命和建设中形成了完备的刑事法治思想.可归纳为五个方面:关于在法律面前人人平等的思想;重证据、重调查研究、不轻信口供,严禁刑讯逼供的思想;少捕慎杀,严禁乱杀的思想;惩办和宽大相结合,重悔改表现的思想;加强法治、严格执法的思想.毛泽东的刑事法治思想对于当代的执法实践具有重要的指导意义.

| Abstract: | In the course of the revolution and construction of New China,Mao Zedong had formed a complete system of thought on criminal law,including following aspects:everybody is equal before the law;lay stress on evidence and investigation;do not readily believe confessions,strictly forbid corporal punishment in examination;fewer arrest,and adopt prudent policy on death sentence,combine suppression with leniency;pay great attention to repentance;rule by law,and enforce law strictly.Mao Zedong's thought on criminal law has great guiding significance for our legal practice nowadays. |
