俄罗斯民事检察权权能演变及其启示

文章梳理了在沙俄、前苏联、俄罗斯联邦三个时期俄罗斯民事检察权权能演变的过程，随着《俄罗斯民事诉讼法典》的颁布实施，俄罗斯民事检察权经历了无限监督到有限监督的蜕变。鉴于我国民事检察制度脱胎于前苏联民事检察制度的历史渊源，我国民事检察权权能完善的路径主要有：赋予检察机关在特定的情况下提起民事诉讼的权能；完善目前在司法实践中存在的检察建议；保留检察机关抗诉的权能，等等。

On the evolution of Russian civil procuratorial power

The present paper first offers a review of the evolution of the civil procuratorial power in Tsarist Russia, the Soviet Union and the Russian Federation, before going on to discuss civil procuratorial power in China. With the promulgation of the Russian Code of Civil Law, the Russian civil procuratorial power had gone over a metamorphosis from an unlimited supervision to a limited supervision. Since the civil procuratorial power in our country had been drawn up on the basis of ex-Soviet Union＇s civil procuratorial system, we can imporve our civil procuratorial power mainly by taking such measures as bestowing the procuratorial organ the power for taking legal action; to improve proscutorial organ suggeston system that exist in practice already; and to retain the power to counterappeal for the procuratorial organ.
