论行政诉讼举证责任的分配

Allocation of the Burden of Proof in Proceedings

The burden of proof is not only a core problem in evidence system of administrative litigation, but also an important evidence system that concerns the realization of value target of fairness and efficiency in the judieial reform. Combined with the cur- rent administrative procedure laws and regulations, this article starts from the assignments of burden of proof. Then the author discuss- es the reason of assigning the burden of proof and elaborates on the essenee and evidence of assignment of the burden of proof in or- der to analyze the burden of proof of plaintiff and defendant.
