| 摘 要： | 在2008年召开的十一届全国人大常委会第五次会议上审议的《中华人民共和国国家赔偿法修正案(草案)》中,首次将精神损害纳入国家赔偿范围,在精神损害赔偿方面有了突破性进展。文章分析了国家侵权精神损害赔偿制度建立的必要性、可行性,并提出了在国家赔偿中确立精神损害赔偿制度的几点建议。
