| 摘 要： | 房地产业成为国民经济的重要支柱产业,但是由于开发商与购房的人经济地位和专业知识的不对等,而导致购房人的利益受损,特别是在商品房预售合同中,以专业术语等隐藏的不公平的条款,不仅违背契约自由原则,违反了双方利益平衡原则,也违反了契约正义的最高追求。

| Abstract: | The real estate industry has become an important pillar industry of the national economy.But the non-equivalence between estate developers and buyers in the aspects of economic status and the specialized knowledge has damaged buyers＇ benefits.Especially the unfair articles hiding in the advance sale contract of the commercial houses by technical terms violate not only the principle of contract freedom and the principle of balanced bilateral benefits,but also the contract justice,the highest pursuite. |
