| 摘 要： | 交通事故责任认定作为交通事故行政处罚、刑事诉讼以及民事诉讼的重要讧据，对行政相对人的权益影响巨大。为了提高交通行政部门行政行为的公正性，维护行政相对人的合法权益，交通事故责任认定应当被列入行政诉讼的受案范围。

| Abstract: | Responsibility recognition in traffic accidents, as the important evidence of the administrative punishment, and the criminal and civil lawsuit, greatly influence the fights of the relative party. In justice of the traffic administrative departments and safeguard the legitimate fights and interests responsibility recognition in traffic accidents should be included in the administrative lawsuit. |
