关于安乐死的立法思考——中国的安乐死立法之路还有多远

安乐死是一个在医学、社会学及法学等领域都受到广泛关注的问题。在法学界 ,安乐死立法的呼声似乎越来越高。但安乐死涉及的不仅是当事人的生与死 ,还涉及到社会的整体秩序、伦理道德及国家所倡导的价值取向。法律不应是纯理想的规则 ,而应是可行的制度。安乐死根本就不应当是一种私法上的权利。面对中国的现状 ,当公正与秩序冲突时 ,中国的安乐死立法还为时尚早。

On the Legislation of Euthanasia

Euthanasia is a widely concerned and discussed issue in different fields of medical science, social science and the science of law. In the field of law, there is a stronger and stronger demand for euthanasia. But euthanasia involves not only the life and death of the agent, but also the social order, moral, and the values advocated by the country. Law should not be defined as a ideal rule but a feasible system. Basically, euthanasia is not a judicial right. Confronted with China's present state, when where is conflicts between justice and order, it is still early to establish the law for euthanasia in China.
