"期成宪草"探微--抗战时期民主宪政运动的重要成果

1940年<中华民国宪法草案(五五宪草)修正草案>(简称"期成宪草")的提出,是抗战时期民主宪政运动发展的必然产物,是当时中国社会各阶层中的爱国民主人士坚持抗战立宪并举,借鉴西方议会民主制度改革中国政治体制的首次尝试.本文运用阶级分析和历史分析相结合的方法,在阐明"期成宪草"于当时必然流产的同时,也充分肯定了它不可磨灭的历史功绩.文章从一个侧面表明了国民党统治下的民国行宪之艰难,展现出中国共产党在抗战时期团结各民主党派,领导中国人民推进民主宪政的斗争历程.

The Further Exploration of QiCheng Draft Constitution--Important Achievements of the Democratic Constitutio nalism Movement during the Anti-japanese War Period

The proposal of The Draft Amendment of the Draft Constitution of the Republic of China(May Fifth Draft Constitution) (Abbreviated as QiCheng Draft Constitution)in 1940 was the natural consequence of the development of the democratic constitutionalism movement during the anti-Japanese war period. It was the first attempt by democratic patriots from different classes in Chinese society, who persited in simultaneously fighting Japanese and advocating a constitutional government to reform the Chinese political system by joining on the experience of western parlimentary-style democracy. This article utilizes both class analysis and historical analysis to explain the unavoidable failure of QiCheng Draft Constitution due to the situation at the time and also affirm its historical importance. The article shows the difficulties of implementing the constitutionalism in the Republic of China and the National Party rule and describes how the Chinese Communist Party united different democratic parties and led Chinese People forward in the struggle for democratic constitutionalism.
