摘    要:商品房价格欺诈行为属于一般侵权行为,其构成要件仍然是违法行为、损害结果、因果关系和主观过错,但也有其自身的特点。作为一种违法行为,商品房价格欺诈行为主要是违反明码标价的法定义务的行为;其损害后果应包括购房消费者机会利益的损失;对商品房价格欺诈行为因果关系的认定应采用推定因果关系规则;在特定情况下,如同故意一样,过失也应当是商品房价格欺诈行为的主观要件。

Abstract:The behavior of price-cheating in commodity apartment is a general tort.The component parts include illegal act,damage,causation and fault,but it has its own characteristics.The behavior of price-cheating in commodity apartment is mainly a behavior violating the duty of displaing price tag pubicly.It should take putative rule to comfirm causation of the behavior.In special conditions,negligence is also the subjective component part such as intent.
