| 摘 要： | 创建于中国西汉的录囚制度,是中国古代司法制度史上一个颇具影响的制度模式.录囚制度自西汉创建起被其以后的各朝统治者所沿用,并且在各朝统治中发挥了重要作用.这一制度从一个侧面反映了统治者"慎罪恤刑"的立法思想和司法理念.对它的深入研究,对于中国现今的依法治国、特别是在最高人民法院收回死刑复核权的大背景下有着十分重大的理论意义和实践价值.

| Abstract: | Being an influential system in Chinese ancient legal system history,the system of interrogating prisoners,established in Western Han Dynasty and adopted by the following rulers,has been playing an important role in ruling of society and reflects the rulers' jurisdiction notion of "being meticulous in applying punishment".A thorough study of this system is of great theoretical significance and practical value in the legal ruling of the nation,especially against the background of the Supreme People's Court's taking back the approval power of the death penalty. |
