品格证据的法律分析

品格证据作为证明材料类型之一,经常见于刑事诉讼之中,在国外尤其是美国对品格证据规则有较为成熟的认识,而我国不论是立法还是司法实践都没有对品格证据的性质、定位和适用规则做出明确规定,本文简要分析品格证据的基本理论及其运用,提出一些对我国证据法修改方面的意见。

Legal Analysis On Character Evidence

Character evidence as a kind of proving material often occurs in some criminal litigations. Many foreign countries,especially the USA,have a profound recognition of character evidence rules,but in our country there is no concrete stipulation over the character, status and application of the character evidence in the aspects of legislation and judicature.This paper briefly introduced the fundamental theory and exertion of character evidence and offered some ideas to the amendment of evidentiary law.
