| 摘 要： | 网络侵权事件层出不穷,在追究侵权人法律责任的同时,网络服务商的法律责任问题成为当前国际互联网发展的一个核心问题,其解决的方法与效果将严重影响互联网业的正常运行和良性发展。在此前提下,研究各典型国家网络服务商法律责任立法,厘清责任限制的界限,进而为我国网络侵权案件的责任归属提供立法与实践上的思路尤为重要。

| Abstract: | Torts on Internet occur frequently in the recent years.Nowadays,when we try to investigate the liability of the tort-feasors ,the liability of Interact Service Provider(ISP) becomes a central problem of the de- velopment of international Internet.How to solve this problem and the effect of solving this problem will influ- ence the operating and development seriously.Under the above background,we studied some typical countries" legislation on the liability of ISP to find out the standard of liability limitation.Through sueh kind of research, we hope to find the way that can help our country to confirm the liability of ISP,both on legislation and in practice. |
