| 摘 要： | 形式法范式在欧陆与美国的出现和发展,是科学主义和理性主义在完成对自然的征服与改造之后向社会生活领域蔓延的结果,其本身也构成了现代性图画上最令人眩目的色彩.但现代性本身所蕴藏的分裂与冲突因素导致了形式法发展的危机,促使形式法开始朝着实质化的方向发展,而福利国家的兴起则对形式法的实质化发展作出了实践上的推动.实质化的法对法律采取工具主义态度,视法律为在具体情境之下为达致特定政策与目标及落实国家价值偏好之手段.

| Abstract: | Formal law developed under the background of modernity, but the conflicted elements deeply hided in modernity lead to crisis of formal law. The rising of the sociological law and the welfare and regulatory state make preparation for the materialization of formal law, which taking an instrumental attitude towards law and regard them as tools to carry out specific policies and obtain values holding by state in particular circumstances. |
