| 摘 要： | 科斯定理引发的持久争议,要求对科斯框架本身加以澄清和反思。科斯框架中的法律界权具有"市场前提"和"市场替代"的双重功能。法律双重功能在科斯定理中的严重混淆,不仅导致了关于交易成本为正条件下法律应当干预市场的错误推论,而且忽略了实际存在的"界权成本",难以充分和全面地解释法律界权的效率影响。

| Abstract: | The Influences of the Law on the Working of the Economic System in the Coasean framework are mainly two functions: the prelude to market and the substitution for market.The two functions of the law for market are economically different.However,the Coase Theorem and its corollaries confound them with each other and lead to the wrong conclusions.The key part is the ignorance of the delimitation cost during the law as the substitution for market transaction. |
