| 摘 要： | 虽然我国的有关立法没有明确国有企业的法人财产权中是否包含收益权,但无论是国有企业还是改制后成立的公司对股东投资的占有、使用和处分都是围绕收益在进行,而公司实际上只是股东追求利益最大化的“平台”。当然公司的收益权也并不就是股东的受益权。
