国际知识产权协议之谈判问题研究

摘    要:贸易与知识产权相结合之后,知识产权谈判由传统的国际公法领域移转到了贸易谈判领域。而贸易谈判协商交换式的谈判模式在适用于知识产权谈判时,由于谈判力量不均衡,缺乏分配机制等原因导致公共利益受到侵害。从谈判力量结构出发,通过审查谈判过程、谈判技巧的运用、谈判方式等,在其中寻求各种能够抵消协商交换式谈判负面效果的有效手段,是发展中国家融入知识产权谈判,摆脱被动地位的必要一步。谈判方式的改革及新型谈判理念和方法的引入,会为发展中国家带来新的视角,使其在知识产权谈判中能够争取尽可能多的利益。

Abstract:After the combination of trade and intellectual property right,the negotiations of intellectual property agreement have transferred from the traditional field of public international law to the area of trade negotiations.The exchange model which always adopt to trade negotiations will damage the public interest if it is applied to intellectual property rights negotiations,due to the uneven bargaining power,lack of distributive mechanisms.Through the review of the negotiation process,the use of negotiation skills,the model of negotiations,etc.,it will be a necessary step to seek for the effective means to offset the negative effect of exchange model negotiations,get rid of the passive status and integrate into the negotiations of intellectual property rights for the developing countries.The reform of negotiation model,and the introduction of the new ideas and methods of the negotiations will provide a new perspective for developing countries,so that the developing countries can obtain interests as much as possible in the intellectual property rights negotiation.
