| 摘 要： | 《物权法》坚持民主立法与科学立法的精神,从实际出发,但又在具体内容的规定上“宜粗不宜细”。《中华人民共和国物权法》在不动产统一登记、公共利益、法律责任、诉讼主体资格、土地使用权等方面或规定得很原则,或没有规定,留下了众多需要进一步明确的问题,这些问题或者需要在司法实践中通过司法程序加以确定,或者需要进一步研究并在立法中加以明确。

| Abstract: | The Property Right Law of the People's Republic of China makes either detailed or rough stipulations in terms of unified registration of real estate, public interest,legal liabilities,suit subject,and the right of land use,thus leaving behind many issues to be tackled.These issues must be tackled through juridical procedures or made clear in legislation after a careful study. |
