基于产权嬗变的虚拟财产保护问题研究

虚拟财产作为网络经济发展的产物,在现有的财产权保护理论中处于尴尬的地位,对虚拟财产的保护出现了盲区。从法学与经济学双重视角进行分析,在现有的法学理论中提炼虚拟财产的虚拟与现实并存性、来源合法性、流转交易性、稀缺性与价值性等基本属性,结合经济学基本原理,特别是其基础性理论——产权理论进行分析,在产权理论中给予虚拟财产以新权利束的理论框定,进而从立法选择规范交易产权测度权利救济等层面进行制度架构,对虚拟财产进行规范与保护。

The Protection of virtual Property Based on Property Right Transmutation

As the outcome of network economic development,virtual property is in an awkward position in the present theory of proprietary protection,in which virtual property finds no protection.Through the analysis from the angles of both law and economics,by refining the basic attributes of virtual property,such as its coexistence of being virtual and real,source legitimacy,circulative transaction,rareness and value in the present law theory,and through being combined with the basic principles of economics,especially its basic theories-property right theory,it is supposed to endow virtual property with new rights bunch in the property right theory.Thus,virtual property can be normalized and protected by carrying on the system framework through legislation option,normal transaction,property right measurement and right remedy.
