| 摘 要： | 我国刑法学界对假想防卫的存在范围的认识是有分歧的 ,假想防卫与防卫不适时、防卫第三者之间的关系如何 ,假想防卫与刑法中的认识错误的相互区分等问题 ,学界的认识也是比较模糊的。文章对上述问题逐一进行探讨 ,试图解决这些问题。

The paper discusses these questions and tries to answer them. |
