民事诉讼检察监督功能的廓清与实现

学界和实务部门有关民事诉讼检察监督核心功能的观点尚存争议，未能厘清各种功能之间的关系，制度利用者对不同功能的过度追求易导致制度功能发生异化。民事诉讼法修改后，民事诉讼检察监督的核心功能仍为法律监督，并未转变为权利救济。在确有监督事由且有监督必要之情形下，权利救济是法律监督功能的自然延伸，因此也应重视权利救济的补充功能。民事诉讼检察监督的社会功能主要包括增强社会公众对司法公正的感受、缓解社会矛盾、维护司法公信力和司法权威、建构法治秩序等。社会转型背景下，民事诉讼检察监督需同时注重法理功能和社会功能。应在注重法理功能的基础上更加重视社会功能，进一步注重息诉等社会功能实现的路径和方法，同时须避免制度利用者过度追求非核心功能导致的功能异化。
