物权变动中第三人利益保护问题新探——试析一种对第三人区分保护的思路

在物权变动中规定对第三人利益的保护,其意义非常重大,很多学者为此提出了各种保护第三人利益的规则,然而,笔者认为,它们实际上大多数只适用于依法律行为的物权变动类型中,能实现的也仅仅是对原物权人之第三人利益的保护,显然有欠周密。因此,文章从区分现实中第三人类型和物权变动类型出发,提出了对第三人利益进行区分保护的思路,即物权变动相对人之第三人的保护规则应有别于原物权人之第三人,同时,依法律行为的物权变动中的第三人的保护规则也应有别于非依法律行为的物权变动中的第三人。

A New Exploration of Protecting the Third Party's Interests in Alteration of Matter Right

It is important to provide protection for the third party in alteration of matter right.Therefor,some scholars have put forward their viewpoints about that.However,there are limitations existing in them which make those viewpoints not enough for protection of the third party.Thereby,the article recommends another viewpoint of different protection of the third party.Besides,the rule of protection must be different between the two kinds of alteration of matter right.
