摘    要:我国现行劳动合同法视野下的劳务派遣同工同酬制度是一项具体的法律规则,具有明确性和可操作性。劳务派遣制度的首要意义是实现灵活就业,派遣工同工同酬权利的实现并不妨碍用工单位节约人力资源管理成本,且重在强调处于相同或相近岗位的派遣工与正式工应当适用同一套劳动报酬计算标准和体系,排除因身份差异而导致的劳动歧视,是一种相对且动态的平等,同时,派遣工同工同酬权利的实现还有赖于剔除劳动力市场中非市场因素对劳动报酬的影响。

Abstract:Equal pay for equal work is one regulation in the Law of Labor Contract, which has definiteness and maneuverability. The main purpose of labor services is to realize flexible employment. To ensure equal pay for equal work will not hinder the saving of management capital of human resources. The rule emphasizes the same calculative standard and calculative system for workers. It will also eliminate labor discrimination, and remain a kind of relative and dynamic equality. Meanwhile, the rule will get rid of influence of non-market elements.
